1. Please Read Carefully Before Using this Web Site.  Your use of this Web site is expressly conditioned on your acceptance of the following terms and conditions. If you do not agree with any part of the following terms and conditions, you must not use this site.

2. We are very confident that your transactions will be secure and safe. The airline reservation systems used by our call centers, for example, are Sabre, Worldspan and Amadeas, computers which process over $60 billion dollars in air travel annually and over 720,000 credit card transactions each day.  FareFinder, however, displays fares in near- real-time

3. In the unlikely event unauthorized use of your credit card occurs, follow the reporting procedures defined by your credit card provider and contact us immediately. Most credit card companies cover all charges that result from unauthorized use of your credit card or may limit your liability to $50.00 US - the maximum liability allowed under the Fair Credit Billing Act. For additional information on the Fair Credit Billing Act, contact the Bureau of Consumer Protection or visit the Federal Trade Commission web site at www.ftc.gov.

4. Travel Promotions International and all of the third party travel providers, distributors, wholesalers and travel agencies, those companies located under the Contact Us section of this Web Site, (“TPI”) want you to feel safe and secure booking your travel with us. For this reason we use special technology to encrypt your member registration information, credit card and other sensitive information when you make reservations for flights with us.

5. Booking and Delivery Information: We will only ship your travel documents to the name and address that appears on your credit card. Although this may present a slight inconvenience in some situations, it has proven successful in eliminating unauthorized use of credit cards. If you would like to have your airline ticket(s) or other travel documents mailed to an address other than the billing address, please address this issue with the travel agent at the time your reservation is made. You may not use a P.O. Box and/or a PMB as a point of Delivery.

6. In order to ensure delivery of your airline tickets prior to your departure date, we will e-ticket whenever possible. Many of the tickets available to our members are at special negotiated prices and do not permit e-ticketing. If you choose to have your ticket mailed to you using the US Postal Service, we will not be responsible and cannot guarantee their safe delivery. For this we strongly suggest overnight delivery at an additional charge. 

7. When you purchase other vacation travel through us (non-air purchases such as resort condo rentals, exotic vacations or a cruise) we will mail your travel documents to you using the US Postal Service at no additional change. If you elect overnight delivery, however, you will be responsible for a $10-$16.95 overnight delivery charge.

8. All reservations must be made in the EXACT name of the person who is traveling.  Please do not use nicknames. Always use your name EXACTLY as it appears on your credit card, driver’s license and/or passport. Please Note: All adult passengers will be required to show valid photo identification (driver's license, etc.) at the airline's check-in counter.

9. You may not change your travel after travel has begun unless permitted by the travel provider and you will be responsible for any additional costs incurred resulting from the change.

10.  As a member, you may occasionally receive e-mail updates about air-fare sales and special vacation values, and noteworthy news. We hope you will find these updates interesting and informative.

11. OWNERSHIP. This site, and each of its modules, is the copyrighted property of the TPI Consulting Group, Inc., d.b.a. Travel Promotions International. Much of the content found on this site is owned by third party travel agencies including airline ticket and vacation wholesalers. None of the content or data found on this site may be reproduced, sold, transferred, or modified without the express written permission of Travel Promotions International.

12. USE OF SITE.  You may only use this site to make legitimate reservations or purchases and shall not use this site to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand.

13. AGE AND RESPONSIBILITY.  You represent that you are of sufficient legal age to use this site and to create binding legal obligations for any liability you may incur as a result of the use of this site.

14. EXCLUSION OF WARRANTY.  Travel Promotions International does not warrant the accuracy, completeness, merchantability or fitness for a particular purpose of any of the content or data found on this site.

15. LIMITATION OF LIABILITY.  In no event shall Travel Promotions International (“TPI”) or GNC be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, incidental or consequential damages of any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort or otherwise, which (i) arises out of or is in any way connected with any use of this site or content found herein, (ii) any failure or delay (including, but not limited to the use of or inability to use any component of this site for reservations or ticketing), or (iii) the performance or non performance by Travel Promotions International, even if such party has been advised of the possibility of such damages, or for any other party.  Some states do not allow the exclusion of implied warranties or the limitation or exclusion of liability for incidental and consequential damages, so the above exclusion may not apply to you.

16. If, notwithstanding the foregoing, Travel Promotions International or GNC should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this site or its content, Travel Promotions International or GNC liability shall in no event exceed, in the aggregate, the subscription fee and service charge for accessing this site with respect to which liability is found. In its sole discretion, in addition to any other rights or remedies available to Travel Promotions International or GNC and without any liability whatsoever, any time and without notice may terminate or restrict your access to any component of this site.

17. The foregoing terms and conditions shall apply to both contract and negligence claims.

18. INDEMNIFICATION. You shall defend and indemnify Travel Promotions International and GNC against any claim or cause of action brought by or on your behalf in excess of the liability described herein or by third parties as a result of your use of this Web Site.

19. RELATIONSHIP. The relationship between Travel Promotions International, third party providers,  distributors or GNC and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other.

20. GOVERNING LAW. This Agreement and its performance shall be governed by the laws of the state of California, United States of America. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles county, the state of California, United States of America, in all questions and controversies arising out of your use of the site and this Agreement.

21. ASSIGNMENT. You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder.

22. MODIFICATION. Travel Promotions International may at any time modify these terms and conditions and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use.

23. ADDITIONAL TERMS. Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and you agree to abide by such other terms and conditions.

24. SEVERABILITY. These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

25. HEADINGS. The heading used in these Terms and Conditions are included by convenience only and will not limit or otherwise affect these Terms and Conditions.

26. ENTIRE AGREEMENT. These terms and conditions contain the entire agreement between us relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing.
